As-is rental agreement

Does anyone have an “As is” rental agreement? or a handyman special rental agreement they are willing to share?

Very insightful to see other people’s view on different paperwork.

I like the exterior list.

On the interior list. Personally I would consider installing smoke and carbon monoxide alarms prior to the sale. In addition I would have the electrician look the home over if there where any possible issues. Also consider possible black mold.

Hey, question; I love that SDGuy gave the the sales agreement but any chance you have a rental as is agreement? Trying to get a unit rented and I need a rental contract.

Honestly if you rent a home that has damage to the point where it could be harmful to the tenant, I could see a judge not caring what agreement you have in writing. Your state may have laws that require basic safety requirements when renting a home that is currently unlivable. If the home is in bad shape and the tenant wants to fix it up have you considered just selling it to them?

Are you trying to rent out a POH or are you trying to rent out a Handy Man special?

If you are renting out a regular POH you can use a standard rental agreement.

Yes, trying to rent out a POH that is in not great shape and the tenant said they would fix it up if he could live there. I just want to CYA and find an agreement that covers that it is an AS IS rental and he has to fix it up. Thank you for replying!

I would do a very thorough job of documenting the conditions before I rented out a substandard unit.

There is this legal concept called “habitability”. It can cause some trouble if you don’t mind your Ps and Qs.

As long as it is demed “habitable” you should be OK with a standard lease. Including a list of conditions as suggested by SDGuy as part of the lease is a good idea.
However do not expect any tenant to ever do any repairs or fixing up of the place as part of your rental agreement. It will never happen.
