When owner of unit is not the same person that lives there, who signs the lease?

E.g. An investor buys a home in the park and rents it out to a tenant.

Who signs the lease?

Also, does the investor pay the park, the end user, or both?

We don’t allow this but have had a few inherited edge cases over the years.

  1. Investor(homeowner) signs lease indicating the they are responsible for lot rent, park rules and everything in the home and on the lot.
  2. Any tenants get fully screened as if they were new homeowners and sign a copy of the park rules.
  3. Any rules violations by the tenant results in eviction action against the investor (see 1 above)

Very interesting. Does seem a bit complicated I admit.

If evicting the unit owner, that seems odd because if the tenant does not leave the house, you need a court order for them, not the homeowner

We have home owner sign the lease and they are responsible for the pad rental every month… not their tenant. We have tenant apply to live and sign the lease. We evict them- not the home owner.

We do not allow this, we say we are the only landlords in the park. What ends up happening is you will be policing their tenant.

The 1st short answer is don’t permit any LL in your community except you/your mgmt co.

The 2nd answer is get an experienced mobile home community lawyer to resolve this matter.

Have same lawyer draft all leases to give mgmt co, exclusivity for non owner occupation or protections for you so you have screening and enforcement rights agains homeowner and nonowner occupants of home.
