I have a small MHP in Texas with a single family home on it. I would like to sell the home but cannot cut out any piece of the land because of zoning/platting regulations. Can I create an easement and sell the home for cash or with seller financing? I would carve out a perpetual easement and sell the home but keep the park.
When i did this, we had to rezone the proposed subdivided house(s) from mobile home park to R1 residential and then get a variance for setbacks for the single family homes. I had to go before city council and they approved it.
I did a “lot split” a few years ago by leasing part of my property to someone else. The lease had a down payment of the purchase price of the lot. The assignable lease was for a 99 year term with an automatic 99 year renewable term. The rent was $1.00 per year payable in advance. The purchaser agreed to pay the prorata share of the real estate taxes. The purchaser had no problem getting a bank to finance a commercial building on the site. Somebody in 198 years is going to deal with the split, but it won’t be us.
I found this to be extremely thorough - though local laws will prevail. Consider applying for a variance. Alternatively have a look to ensure that the ordinances are compliant with state laws. These small towns sometimes overstep their bounds to give themselves more favorable authority over who can do what.
