I Just got off the phone with the sellers daughter ( she’s been my point of contact for the most part) I had asked her if she could make sure she has the mobile home titles ready because we are supposed to close in a couple of weeks.
Well, Looks like they don’t have the titles just a bill of sale!
The P&S only states that all dwellings are included in purchase. The only title search required was for the ranch home that is on the property… Its a very unique property
I’m no lawyer, but i think that verbiage should have been more detailed. Maybe a lesson learned for you. When we buy parks with homes, our PA’s have more details regarding the park owned homes, such as getting the titles, and a financial penalty for the seller not transferring the titles properly
You can likely get new titles through the state, in my experience in Indiana, that process can be long and frustrating, especially the first time you do it.
The only person to answer this for certain is your closing attorney. It’s been a few years since we owned in Maine, but I’m 90% certain POHs were transferred with just a bill of sale last time we did it. The BoS all get recorded with the town (in theory).

Does this mean mobile homes built before 2007 did not require title?
Also, all of the BOS came with a cert from the town tax clerk stating no leans on the mobile homes…
“6. Manufactured housing. Beginning October 1, 2007, the Secretary of State shall issue
certificates of title for new single-unit manufactured housing beginning with model year 2007.
Beginning October 1, 2007 and ending September 30, 2009, the Secretary of State shall issue a
certificate of title for used manufactured housing that was previously issued a State of Maine certificate
of title. Beginning October 1, 2009, the Secretary of State may issue a certificate of title for used
manufactured housing that was previously issued a State of Maine certificate of title or a model year
2007 or later model that was never issued a certificate of title. A certificate of title issued pursuant to
this subsection remains in effect unless cancelled pursuant to section 669.

I own two parks in ME. Both Parks came with a few POHs.
We received only a Bill of Sale; no government title was issued. That sketched me out, but the Bank we financed the park with was fine. The POH income was used for underwriting; they only wanted the BOS.
