Im hoping someone with experience could point me in the right direction on this one. We have 3 homes that were abandoned in our park just south of Oklahoma City. The only thing we have is the serial number. Were trying to title it into our name so that we can sell the home. Is this a process we can do on our own or do we need to have an attorney do it? If so, does anyone have a good referral for an attorney in OKC or south of their? I tried going online and the process seems very confusing and complicated.
You have to go through an “abandonment” proceeding before you can claim any ownership of the homes. You need to use a licensed attorney to do this, or you risk screwing it up. Once you have completed that, you can then go about getting the titles. I do not know the current procedure, but you can call the OK MHA and they should know. To save time, you should pull the current titles on those three homes, and try to contact the owners, and see if they will assign the title over to you. If there are any 'lien holders" on the current titles, you might go ahead and contact them, too, to get the process on a release started.
thanks Frank, we tried those avenues with no luck so we need to go the abandoned home route which is always a long drawn out affair. Jefferson, you have a park in Oklahoma very close to mine, do you have an attorney you could recommend? have you dealt with abandonments at your park?
NADA publishes a vehicle titling book. It is a compilation of all states procedures for all issues regarding titling.
We have done the process and you DO NOT need an attorney. Download the forms from the state under Title 42 and follow the directions. The process takes less than 30 days and we just helped another park owner with the paperwork in our office. The county tax assertor has information on the home plus your local tag agent for a $1 can give information on lien holder and or owner. It is a very easy procedure that is invaluable to park owner in OK and in our case if 30 date late we start the action and the last time we received back payments plus late fees thus we do not spent time with
attorneys, except drawing-up guidelines.
We’ve not had abandoned homes - at least not that people haven’t signed-over to us. I can recommend some attorneys to stay away from, but I’ve never found a good evictions attorney in Oklahoma. Steven, you need to know HOW to do it. It is a tool that park owners can easily learn and YOU DO NOT NEED AN ATTRONEY since the State will walk you through the necessary steps and if you do one the next is a breeze.
