Been lurking for a while and currently has 170 pad, still actively expanding by brrrr parks. Figured will put this as a DP for fellow GA park owners out there.
Long story short local city pulls “if home removed from lot and not replaced within a year, the lot becomes unusable” bs. We lawyered up and basically told them it’s against OCGA 36-66-7 and previous case law in other states have almost exact case and the judge in state superior court ruled in property owner favor.
City won’t listen. So we’re at county level rn waiting for a hearing to be set and likely will go to the state superior court. And interestingly since OCGA 36-66-7 is a new law went in effect not long ago so we might actually be the first example in GA state
If anyone’s interested I’ll keep this post updated once we have the final result as a DP
Thanks! It’s Grovetown GA. A nice suburb and our park located right across the street from their city hall so I can understand why it’s an eyesore lol. It’s been seen a lot of development so part of the effort is to encourage us to rezone
oh yeah I know that area. It is a shame that many georgia municipalities are ignoring the law that was just passed. Bartow County takes the same position
Yes! Hopefully the state court judge makes the right call. I’m honestly surprised they’re rock solid and didn’t back down on their position but I guess we’ll see…
