Concrete pan insulation

Our concrete pad was poured and the workers have installed foam board around the parameter. The job looks sloppy and the foam board itself looks to be 1.5 inches (code is supposed to be 2 inches I think). We live in upstate cental NY so the winters get cold/freezing.

How important is it that the foam insulation around the concrete is installed flush to the pad? The concrete bows out in multiple areas and therefore the foam board bends in those spaces. It looks bad but wondering if its really okay because of the covering that will go over it.

We are just at a loss as every step of the way the pad has had issues.

I don’t know a whole lot about your specific issue with the foam, but I can tell you that we own northern pads, and we don’t use any foam. I suppose if it works for us near Chicago, it should work in NY assuming the code enforcement people approve it. The main issue is you have a bad contractor so hopefully you can find a better one in the future.
