Texas- Eviction

Just purchased a mobile home park in Texas.

I have no lease in place.

The previous owner had no lot lease in place. Just mobile Home park Rules.

I want to evict someone because they have a mess outside it looks very trashy.

I asked them to clean up and they have not complied.

If there is no lot lease in place is it considered a month to month lot lease?

If so I can refuse to renew the lease with 60 day notice?

Can violating the mobile home park rules be grounds for eviction if there is technically no lot lease?

Have you accepted lot rent without a written lease? Don’t do that.

I highly suggest you go get an attorney.

Then go become a member of the TMHA and access the forms for leases, the Notice that they get an initial 6 month lease, etc. and the Rules. Then Give them 10 days or 30 to get into compliance with the rules by certified mail or will be evicted. Then document the lease violations, then go file for eviction based on the lease violations. You can also start fines and when they don’t pay the fines, you are evicting for money and conduct.

Get the attorney to draft you abandoned property addendum to the lease, assigning you to attorney in fact, so when they are evicted, the home becomes yours after 15 days of abandonment, otherwise you have issues about possibly having to move the home to storage or sheriff sale, etc.
