Park Referrals to Buyers

Regarding referring parks that are too large for us or do not fit what we are looking for to another buyer. For others who have gone thru the process, is it as simple as verbally connecting the seller and prospective buyer as the go between? Paperwork, etc? Referral, not assignment or having the park under any formal contract.

I guess it all depends. It never hurts to protect yourself by formalizing things with a referral agreement or assigning a signed contract. The buyer won’t get offended if you require that they sign something. If you feel like they can be trusted then have a verbal.

Check your state regulations. Referrals in some states is enforced by the Real Estate Commission, and can be considered “valuable consideration” authorized to those only with a license to practice.

In Texas, referral fees to unlicensed people is limited to $50. So a court here would not only consider an agreement for more than $50 unenforceable, but you’d be letting them know you broke the law too.

It could also be a sign of goodwill between investors to just offer the referral since you aren’t purchasing. They might remember that referral and offer you one someday that they can’t purchase. Networking is priceless sometimes.

100% agree with this. If your referral is good and results in a closed deal, you will be remembered. Just be a good person and you will likely benefit.

An assignment where the Seller is obligated to sell is different.
