You can’t file eviction probably, due to the rule in most courts that you cannot evict until the water amount equals at least one month’s rent. So just non-renew their lease. That will get their attention. If they are not paying because of giant water bills, then you might as well get rid of them as they are costing you a fortune in water, anyway. The bottom line is that, on a month-to-month lease, you hold all the cards and they hold none. Let them know that and, if it does not change their behavior, remove them and get a better tenant.
