How to evict a crazy tenant

Assuming her lease is on a month-to-month basis, just non-renew her lease

We have evicted quite a few tenants over the years, for various reasons and with different magistrates. I’ve summarized some considerations below:

  1. As stated previously, different magistrates will rule differently even if they’re within the same state and within the same county. If you have seen your magistrate previously and have some relationship with them, I would not be afraid to stop by their office to ask them if they will hear a rules violation. They cannot give legal advice and they will remind you of that. But, having a conversation will save you time and money.

  2. If your state as a “manufactured housing association,” contact them and ask them for some advice. In my home state of Pennsylvania, we are blessed to have an amazing association. The vice president of our association knows more about the eviction process than most Landlord-Tenant lawyers. Become a member of your association and tap into the wealth of free knowledge that they can provide.

  3. Talk to the other residents that have witnessed the behavior of this tenant. Ask them to come to court with you and testify as a witness. Earlier this year, one of my tenants and her daughter took off from work to testify at a magistrate hearing. Their testimony was extremely powerful and when the magistrate heard their stories, he became visibly irritated with the defendant and gave us his decision quickly.

In closing, an eviction is rarely just between you and the resident. In nearly all of my evictions over the years, that resident’s actions are impacting your community. Always present your cases as you protecting your residents and your community and you will be successful.

Have you had any success/development with the case, OP?

It sounds as if prior owner just had a simple verbal month to month lease? In NC, it is as simple as non renewing her month to month lease without giving a reason. I’m not an attorney but do have parks in NC.
