You need to read the current rules for the Housing for Older Persons Act but in practice you just declare yourself to be a 55+ community if you already are, or if you are empty and starting a new one. There is no registration form or agency to report to. You are just on the hook for being able to prove it at any time.

The last time I looked at the administrative rules 14 years ago they required you to take a survey of everyone who lives in your park to see how old they are: annually. I have never done that after the first survey because in Oregon, where I live, people don’t get younger as time goes forward. I’m not sure about the rest of the country.

In 50 years of owning 55+ parks we have never been asked to prove our status, but then again, we have never screwed up and managed our parks to where the status would be in question.
